WPBA 2009 "Play for Fun Game Room" Sweepstakes Official Rules
NO PURCHASE NECESSARY. A PURCHASE WILL NOT INCREASE YOUR CHANCES OF WINNING. 1. Sweepstakes Period. The WPBA 2009 "Play for Fun Game Room” Sweepstakes (the “Sweepstakes”) is sponsored by the Women’s Professional Billiard Association (“Sponsor”) and begins at 12:01 a.m. Pacific Standard Time (“PST”) on May 13, 2009 and 11:59 p.m. PST on December 31, 2009 (“Sweepstakes Period”). 2. Eligibility. Sweepstakes is open only to individuals who are legal residents of the 48 contiguous states of the United States and the District of Columbia and who are eighteen (18) years of age or older at the time of entry (collectively, “Entrants”). In addition, Members of the Women’s Professional Billiard Association, its employees, representatives, affiliates, subsidiaries, advertising and promotion agencies, and immediate family members and/or those living in the same household of any of these are NOT ELIGIBLE to enter the Sweepstakes and employees of Brunswick Billiards, Inc., Brunswick Corporation, Brunswick Bowling & Billiard Corporation (collectively, “Brunswick”), their representatives, affiliates, subsidiaries, distributors, advertising and promotion agencies, immediate family members and/or those living in the same household of any of these are NOT ELIGIBLE to enter the Sweepstakes. Sweepstakes is void where prohibited by law. All Federal, state and local laws and regulations apply. 3. How to Enter. There are two ways for qualified Entrants to enter the Sweepstakes: (1) by completing the required information on the official entry form, available while supplies last, at the qualifying seven (7) WPBA events, as designated below (collectively, the “WPBA Events”), and depositing it in the designated Sweepstakes entry box during regular event hours at each WPBA Event; or (2) by visiting the website located at www.wbpa.com and following the directions for Sweepstakes entry and submitting the official entry form on-line during the Sweepstakes Period. Official entry forms must include Entrant’s name, address, telephone number, e-mail address, and date of birth, and must be received by Sponsor, as defined herein, during the Sweepstakes Period. Limit one entry per person (regardless of entry method). Void where prohibited. A purchase will not increase your chances of winning. No mechanically-reproduced entries permitted. Proof of submission is not proof of receipt. Sponsor, as defined herein, is not responsible for lost, late, mutilated, illegible or incomplete entries. All entries become the sole property of the WPBA and will not be returned. WPBA is not responsible for technical, hardware or software malfunctions, misdirected entries, lost or unavailable telecommunications or network connections, failed, incorrect, inaccurate, incomplete, lost, late, illegible, misdirected, garbled, damaged or delayed entries, or any other communications or other technical problems related to entries. WPBA, in its sole discretion, reserves the right to disqualify any person who tampers with the entry process or the operation of WPBA’s website, or who otherwise violates these rules. PRIZE/ APPROXIMATE RETAIL VALUE/ODDS OF WINNING: One winner, as described below, will receive the following prize: a complete Brunswick game room package with an approximate retail value (“ARV”) of Ten Thousand One Hundred Ninety Three Dollars ($10,193), which shall include the following: one (1) Brunswick “Traditional Style” Camden pool table (ARV = $4,549); winner’s selection of Centennial® Cloth from twelve (12) popular colors (ARV = $400); one (1) Madison Bar (ARV = $2,329), one (1) Players Chair (ARV = $799), two (2) leather Heritage Barstools (ARV = $1,058); one (1) cue rack (ARV = $359); one (1) Centennial® Play Kit (ARV = $699), consisting of Brunswick Billiards’ exclusive “Getting Started” instructional DVD, featuring Billiards Hall of Fame member, Ewa Mataya Laurence; one (1) BCA Rule Book, the official rules of the Billiards Congress of America; one (1) set of Centennial® pocket balls; four (4) Centennial® cues; one (1) two-piece short cue; one (1) two-piece bridge stick; one (1) Brass bridge head; one (1) Big Break® rack; one (1) Table Brush; twelve (12) pieces of finest velvet-grade silica chalk; and delivery and installation (within the contiguous United States and District of Columbia) by an authorized Brunswick dealer (collectively, the “Prize”). Odds of winning depend on the number of eligible entries received. Prize is non-transferable. No substitution of Prize for cash or other goods and services is permitted, except that Sponsor reserves the right to provide a substitute prize or substitute prize components of approximately equal or greater value. Prize and Prize component details are subject to availability. All expenses not specified above, including, without limitation, all federal, state and local taxes are the sole responsibility of the winner. Allow six (6) to eight (8) weeks for delivery of Prize. 5. Winner Selection. Sponsor will randomly select one (1) winner on or about January 4, 2010 from all qualified entries received by Sponsor during the Sweepstakes Period at the address specified in Section 8. Potential winner will be notified on or about January 4, 2010 by email to the email address specified in the official entry form or by telephone at the number specified in the official entry form. If potential winner cannot be contacted at the email address or telephone number provided on the official entry form, or is contacted and does not respond as directed within fourteen (14) days of attempted notification, refuses the Prize, or is ineligible to accept the Prize, Prize may be forfeited and awarded to an alternate winner. Prize claimed in accordance with these rules will be awarded. Winner will be required to complete and sign an Affidavit of Eligibility and, except where prohibited, Liability/Publicity Release, in the form provided by Sponsor, within fourteen (14) days of attempted notification in order to claim Prize. If winner is at least 18 years of age as required by these Official Rules, but a minor in his or her state of residence, Prize will be awarded in the name of his or her parent or legal guardian, who will be responsible for signing all documents, affidavits, and releases. In the event of a dispute regarding the identity of the person submitting an official entry form, the official entry form will be deemed to have been submitted by the person in whose name the email address is registered or, in the event no email address was provided with the official entry form, by the person in whose name the telephone account is registered. Sponsor, in its sole discretion, reserves the right to cancel or modify the Sweepstakes if fraud destroys the integrity of the Sweepstakes. All official entry forms, including any survey information submitted therewith, become the property of the Sponsor and Brunswick and will not be returned or acknowledged. 6. General Conditions. Entrants and winner assume sole liability and accept all risk of loss for injuries, including personal injuries and/or damage to property, caused or claimed to be caused by participating in this Sweepstakes or the acceptance, possession, shipping and handling, loss, use or misuse of, or travel to or from or in connection with the Sweepstakes and/or Prize awarded. Sponsor has the right to cancel, terminate or modify this Sweepstakes if it cannot be completed as planned due to computer virus, bugs, tampering, unauthorized intervention, technical failures, or other conditions beyond Sponsor's control and to select winner from eligible entries received on or before the termination date. Sponsor is not responsible for any failure to contact entrants, whether due to technical or human error. By entering this Sweepstakes, Entrants grant to Sponsor a worldwide, perpetual, irrevocable, right and royalty-free license to use the entry, and, except where prohibited by law, entrant’s first and/or last name, city and state of residence, photo(s), voice and/or likeness; all on television, radio, publications, and the Internet and telecommunications networks, including on the websites of Sponsor and/or Brunswick. By entering this Sweepstakes, Entrants agree (a) that Sponsor and Brunswick each have the right to exploit and utilize entrant’s first and/or last name, city and state of residence, photo(s), voice and/or likeness in any and all media in and in connection with promotion, publicity, marketing and advertising for Sponsor, Brunswick Billiards, this Sweepstakes or other promotions by Sponsor in Sponsor’s discretion without any further attribution, notification or compensation to entrant; (b) to be bound by these Official Rules and the decisions of the judges; (c) to be contacted by Sponsor or its agents by telephone, mail or email regarding this Sweepstakes. Sweepstakes is governed by the laws of the state of California applicable to contracts entered into by California residents and to be performed within such State without regard to its conflict of law provisions, with venue in San Francisco County, California. By entering the Sweepstakes, and unless Entrant designates otherwise on the official entry form, Entrants authorize WPBA to share with Brunswick the information contained on the official entry form and Entrants authorize WPBA and Brunswick to contact them for promotional purposes. All information collected from Entrants is subject to Sponsor’s Privacy Policy (as to WPBA’s treatment of information), as well as Brunswick’s privacy policy located at www.brunswickbilliards.com (as to Brunswick’s treatment of information). 7. Winner List. Winner information will be available at www.wpba.com after winner is confirmed and will be posted for approximately two (2) weeks. Winner information is also available by sending a stamped, self-addressed envelope to “Winners List: Play for Fun Game Room Sweepstakes” c/o WPBA, 2219 East Thousand Oaks Boulevard, Suite 102, #287, Thousand Oaks, CA 91362, which must be received by January 31, 2010. 8.
